New Jersey landlord evictions
Our landlord eviction lawyers review the lease, rent arrears and violation records, prepare the required notices, and file eviction cases in the Landlord/Tenant Section of the Special Civil Part of the New Jersey Superior Court. New Jersey’s Anti-Eviction Act requires a legal cause for most residential evictions, and New Jersey law prohibits residential landlords from changing the locks or forcing tenants out themselves.
Attorney responsible for this page: Michael R. Curran, licensed in New York and New Jersey. Office: 36-09 Main Street, Suite 5-D5, Flushing, NY 11354.
Frequently asked questions
Do I need a real estate lawyer to buy a home in New Jersey?
The law does not require one, but it is common. A New Jersey residential contract prepared by a broker usually has a three-business-day attorney review period, during which either side's lawyer can change terms or cancel. After that period, changing the contract is much harder.
If a tenant is behind on rent, can the landlord just change the locks?
No. A New Jersey residential landlord must evict through the court and have a court officer carry out a warrant of removal. Changing locks, shutting off utilities or removing the tenant's belongings yourself can create legal liability.
