Patents and federal trademarks are filed with the U.S. Patent and Trademark Office (USPTO) and copyrights are registered with the U.S. Copyright Office; these federal processes call for lawyers who know U.S. intellectual property law. Our IP lawyers provide patent, trademark, copyright and trade secret services to New Jersey businesses, startups and individual inventors: our New Jersey trademark lawyers can handle U.S. trademark applications and renewals, and our copyright lawyers can help with registration and enforcement.

About New Jersey patent services: filing patent applications and responding to office actions before the USPTO on an applicant’s behalf must be done by a patent attorney or patent agent registered with the USPTO; we confirm who will handle the matter before engagement.
For imported goods involved in a U.S. International Trade Commission (ITC) Section 337 investigation, see Section 337 and import IP disputes.

Frequently asked questions
What is the difference between a New Jersey IP lawyer and a U.S. IP lawyer?
Patents and federally registered trademarks and copyrights are examined and registered by U.S. federal agencies, so a New Jersey IP lawyer handles the same federal matters. Trade secrets and some trademark rights also involve state law. Location mainly affects which court hears a lawsuit and how convenient in-person meetings are.
Does a Chinese company need a U.S. trademark attorney to file a U.S. trademark?
Yes. Under USPTO rules, trademark applicants domiciled outside the U.S., including companies and individuals in mainland China, must be represented by an attorney licensed in the U.S. to file a U.S. trademark application.
When do I need a Section 337 lawyer?
An ITC Section 337 investigation targets imported goods alleged to infringe U.S. patents, trademarks or other IP and can lead to an exclusion order barring those goods from the U.S. market. Companies exporting to the U.S. that receive a 337 notice should preserve product records immediately and confirm the response deadline.
